Something doesn't make sense here with the story as presented. The judge still has discretion over whether the case was in fact aggravated assault with a firearm (and the accompanying mandatory sentence) or whether the charges should be reduced to something else. There is all kinds of legal nonsense and parlour type games judges can exercise.
Shooting into a wall in Florida is a bad idea. Killing an intruder is perfectly fine.
That means that the old rules for handing a loaded weapon applies:
1. Do not load a firearm unless you intend to use it.
2. Do not point a loaded weapon at anyone you do not want to kill.
2. Do not fire it at anyone unless you intend to kill them.
Obey those rules in Florida and you won't go to prison.
That said, this man deserves clemency but don't look to Obama to do anything about it (which he absolutely can) because this involved one of those scary guns that makes people like Obama wet themselves.
