Court of Quebec Judge Lori Renée Weitzman has ordered Luka Magnotta to stand trial for first-degree murder in the death of Concordia University student Jun Lin in May 2012.
Judge Lori Ren?e Weitzman, who heard from more than 30 witnesses in recent weeks, has ruled there is enough evidence to proceed to trial in the case.
Uhhh didn't he post a video of himself doing it online? If so I fail to see how there could be a lack of evidence.
The Defence tried to argue the appropriateness of 1st degree murder vs 2nd degree:
Luc Leclerc, who is representing Magnotta, told the judge that the Crown must show that the killing was both planned and deliberate for a charge of first-degree. He said based on his analysis, the judge cannot conclude the evidence presented at the hearing justifies that charge.
He'll stand trial for murder 1. Defense lawyer tried to argue for 2nd degree murder, but there was no chance in hell of that happening, unless of course the judge just happened to fall off a tomato truck.
In my opinion, Canada should entertain the possibility of re-instating Capital Punishment. In a perfect world, Mr. Magnotta should have faced a Capital Murder charge. Conviction of a Capital Murder charge would have provided Jun Lin's family members with both justice and closure.

Apparently recorded images in the Cole Harbour rape didn't count as evidence so anything could still happen in the Magnotta trial. One only hopes the police work in Montreal in this case was a lot better than the one done in Nova Scotia. If it isn't then Luka'll be doing the twinkiest happy dance imaginable when he walks out of the courtroom.
So like "Your honour this murder was not premeditated. My client just happened to have a cued up running video recorder, knives and restraints all ready to go when an argument broke out and this just happened."
Ugh, well I guess he's paying (or we are)his lawyer to try, even if he sounds dumb in the process.
