Doubts had been gnawing at Simi Valley Police Det. David Del Marto. In elaborate detail, Tracy West had told him that Gonzalez, her ex-boyfriend, had ambushed and sexually tortured her in her home between 12:30 and 12:45 p.m. on Feb. 1, 2008.

    Great example of good police work though. He had the presence of mind to question what looked like a very believable scenario. I can't imagine what that poor guy went through and the fact that he will still forever carry the spectre of guilt even with the writ of factual innocence.

    As usual, the woman bears no consequences for her actions. Whether she was really attacked or not, she obviously lied to implicate her former husband. You see it all the time with false rape charges too. The woman will admit she lied, and the prosecutors do nothing, because she was "emotionally distraught."

    This is ridiculous. Anyone who knowingly makes a false claim and deliberately files a false police report should be charged and locked up at least as long as their victim was locked up for.

    The problem of course, Brenda, is that they can't prove that she lied. If the guy had been in Las Vegas the whole time, that would be proof, but here there was the possibility he did it.

    I understand that. But they have not been able to prove he was there either. No DNA, no nothing. She could accuse me, and I would probably not be able to prove otherwise. If I was just home doing my thing, without any witnesses, then my neighbour could say the same shit about me...

    It's a scary world we live in...

    From the story:

    They knew a jury wouldn't convict him but said they couldn't be positive of his innocence.


    I think they have it a little backwards there.

    Yeah, it would have been a real bugger for the woman if Gonzalez had missed his flight from Las Vegas that day. She'd have been accusing him of this crime and he'd have still been in Las Vegas.

    I did one job about 10 years ago when a social worker claimed her estranged husband raped her. I didn't believe her. She recanted after he spent 2 weeks in a very nasty jail. She was charged and got 12 months probation on conviction, she kept her job and sole custody of their kid.

    It's not a justice system, it's a legal system.
