Police have charged a 16-year-old boy in connection with an alleged sexual assault involving a 12-year-old girl at a school field in northeast Calgary.
If a man gets 3 years for kicking another man to death in Alberta (previous story), this boy will probably get an afternoon detention if found guilty of sexually assaulting a 12-year-old girl!
All had been drinking. I thought the legal age for that was 18 or 19. She was 12, he was 16, she cannot consent to sex (although apparently she did) but she (they) can decide to drink?

Don't be a moron, B.
But, she may have lied about her age, which might give this guy an out.
I guess you miss my point. HE is being charged for sexual assault, but they all are not charged for underaged drinking. It shouldn't be and/or, it should be and/and.
I doubt if they found them actually drinking. You want to give them a breathalyser to determine if they're drunk? What do you think the penalty might be for u a drinking anyway? Kinda pales by the statutory rape charge, no?

Yep, give them a breathalyser. They claim ALL have been drinking. I don't care what the penalty might be, that's not the issue.
Now it's all his fault alone, which, imo, is utter bs. They are both not particularly innocent.
My point is that when a girl gets "sexually assaulted", it's HIS fault by default. That is just not always the case. Rape is a big deal. A VERY big deal. And cases like this take away the seriousness of a REAL rape case, where someone is forced to have sex against their will, never able to forget it, and having an affect on ones life forever.
This is nothing more than a case of kids fooling around. Sure, 16 and 12, not very streetwise. But from what I read, it is FAR from rape. They were drunk. At 12. Thats a big issue that needs to be worked on.
It just isn't done Brenda. I'm sure even if cops catch underage kids with booze, they just empty it out and take the kids home to their parents. Unless the kids were doing something else to cause trouble as well.
I guess you're just looking for something to hang on the girl. But she's not making any charges. It's the state in it's wisdom decreeing that she can not give her consent. And, I gotta say, I agree with that law. What I don't want to see, which you see more in the states, is the boy branded a heavy duty sex offender, given a long jail term and his life ruined. OTOH, at 16, he can be expected to have some smarts, and he didn't show them here.
Sheesh, I remember helping my 16 year old girl friend run away from home. We got caught of course, and I was lucky to be just under 18, so all they did was tell me to go home.

I agree. Just because she was 12 doesn't mean she wasn't ready willing and able. Charging a boy for rape and putting him a sexual offenders list that will stigmatize him for life is far beyond fair. Let the parents deal with it and not the courts and don't destroy lives which these charges might certainly do.

BTW, you are contradicting yourself with this post. The drinking part "is just not done", the girl "isn't pressing charges, but the state" (maybe they should press charges against the drinking part too?) and you "don't want to see this boy branded for life by this", which is exactly what is happening now. So, what is it exactly that you want to say?

I've overheard girls this age talking about "to lose it" BEFORE starting junior high school. Apparently nowadays girls are losers if they are still virgins at 13 . So a 12 year old consenting to sex does not surprise me at all.
Hopefully one of them at least had the sense to bring a condom. Even sadder than a 12 year old having sex is a 12 year old getting knocked up.
"Brenda" said I guess you miss my point. HE is being charged for sexual assault, but they all are not charged for underaged drinking. It shouldn't be and/or, it should be and/and.
I think underage drinking is hardly a priority here. Besides no one ever really gets in trouble for that you just get taken home to your parents.

It was the same when I was in high school. Terrified of being labeled a virgin you either lied about it (probably most of us did anyway) or hooked up to shed yourself of it. I had friends who basically hooked up with each other just to lose their virginity at a party.
