The owner of the shop who arrested the guy was accused of kidnapping and carrying a concealed weapon because he had a boxcutter on his belt ! Those two charges were dropped but come on ! Kidnapping ! He arrested the guy and called the police. The only problem is that he caught him one hour after when he came back and that he had to used force. When you arrest a thief who tries to get away, you HAVE to use force to control him.
I think he will be acquitted. But an amendment to that law to clarify it is a great idea.
I knew that law, section 494 of the CC. But I didn't know you could be arrested when you do it depending of the type of arrest.
