Canada violated Khadr's Charter rights, Supreme Court says

Omar Khadr is not coming home yet – but the Supreme Court of Canada has moved his repatriation considerably closer. In an 9-0 ruling this morning, the Court said that Canada violated Mr. Khadr's Charter rights by participating in illegal interrogation

    IV. Conclusion

    The appeal is allowed in part. Mr. Khadr?s application for judicial review is allowed in part. This Court declares that through the conduct of Canadian officials in the course of interrogations in 2003-2004, as established on the evidence before us, Canada actively participated in a process contrary to Canada?s international human rights obligations and contributed to Mr. Khadr?s ongoing detention so as to deprive him of his right to liberty and security of the person guaranteed by s. 7 of the Charter, contrary to the principles of fundamental justice. Costs are awarded to Mr. Khadr.

    Oh oh - Harper's going to prorogue again so he won't have to act on this ruling. Why won't people just let him govern?

    I think they did:
    However, the court said that before stepping in to dictate a Canadian response on a sensitive question of foreign policy, the federal government must be given a chance to rectify Mr. Khadr's plight.

    But should the government fail to act, the court warned that it has the power to move more overtly to aid Mr. Khadr.

    I was referring to not forcing Harper to ask the US to repatriate.

    I think they are threatening to do just that if Harper sits on this hands. I'm not sure what the other options are they envision.

    Where did I say it's Harper's fault? It certainly is Harper's responsibility to deal with, and the court is limiting his options more and more. Proroguing this one just won't work.

    If the SCOC wants this kid repatriated so badly why dont we do just that but place him in prison.....in the general population, I am sure the inmates will gladly take care of him :twisted:

    What Harper might do is this: fart around on it long enough saying he is studying his "options". By then the US will have tried him. If acquitted he comes back to Canada. If guilty he'll be in prison. Then Harper can ask the US to repatriate him to a Canadian prison for his sentence. Either way he's back in Canada.

    I doubt if he would ask tho, and probably the Supreme court can't make him. They've done this with some lower profile prisoners, where they didn't allow the to be repatriatred, and I can't say I blame them.

    If Khadhr comes to Canada, I would like to see him and the Khadhr women deported. Khadhr does fit the definition of a child soldier, but I don't really want him running around loose in the country. "Will no one rid us of this meddlesome muslim?"
