Officials said Wiener had a history of medical problems that put him at greater risk. After being diagnosed he was given a variety of anti-viral drugs that proved futile.
It will be interesting to see what their argument is; Should the city have had more effective drugs available in anticipation of the outbreak?
According to a Dutch news article, she said it was because the City had failed to make sure he was working in a safe workenvironment... (she works at the same school he worked... )
Kinda reminds me of a Law and Order: SVU episode (the one with Hilary Duff) where Duff's character sues the city because her dead child contracted measles at a city park.
I knew the Yanks were sue-happy but this really is sinking to an all new low. It's a virus ffs. You can't do anything to prevent any one person from getting it besides putting them in a hermetically sealed bubble.
I've often wondered why Canadian lawyers don't work pro-bono. To me it made sense so if someone had a legitimate civil claim, they could pursue justice. But then a story like this pops up and I understand why we don't have that option here. Stupid frivolous lawsuits(like this one). It's a shame the man died but to blame the city is a pretty big stretch.
Wiener's family charged that the city was negligent for failing "to timely report an outbreak of a communicable disease," to warn Weiner that he had been in contact with people infected with it, and to use the best methods to fight the outbreak.
After his death, Bonnie Wiener, who also worked at the school, blamed the city for failing to act sooner. "I know we have a duty to educate the children of New York," she said, but "something just doesn't fit right."
Yeah, the thing that doesn't fit right is your damn brain in your head.
Unless she can suggest a practical procedure that could have avoided this whole situation that they never thought of, that's realistic, then she doesn't have a damn case.
$40 million? Even Canadian teachers don't make that much in their lifetime, and I would know. Where is the justification of $40 million?
Some say you can't put a price on love, but it appears one can put a price on death.
Can somebody sue another for complete idiocy?
I'm sure NY did pretty much what everybody else in the world did to try and prevent this.
They taught in a school with a bunch of kids.... did she somehow expect not to get any illness at all during their careers?
Shall we sue for head lice, scabbies, common flu, common cold, snot flingers and butt pickers while we're at it?
A sad state, whenever someone dies someone else is looking to make a buck off of it. I'm betting the lawyer approached her and not the other way around. I'm also betting that even if the family was warned ahead of time this man would have died
I especially like this quote
"Officials said Wiener had a history of medical problems that put him at greater risk."
Why the hell was he working at a school if this is the case, seems to me he knowingly put himself in danger.
He had arteriosclerosis and high bloodpressure. Oh, AND he was severely overweight. Does she have a case? Ah, no. Should she be sued for wasting everybodies time? ah, yes.
