This is bullshit. He wrote on his application he had worked for the KGB. They all came into the country on that application. So either they ALL be deported, or they all stay.
It's ridiculous it takes Immigration 11 years to decide that half the family can stay on the same application. Let the guy stay, and admitt your mistake.
I seriously doubt if he were coming here to spy he would put down he worked for the KGB. I think they cover that in the first week of spy school: Never admit you're a spy!
