New details at hearing for soldier accused of murder

A Canadian army captain accused of shooting and killing a severely-wounded insurgent after a deadly battle in Afghanistan could be released from a military prison on Wednesday.

Not really - he's only been released on his own recognisance - he'll be back - it will take at least a year for his actual trial, probably longer - in the meantime, he, or his lawyer, will make his half-dozen bs appearances - this guy is in for major changes in his life regardless of whether he is convicted, or not.

However, if he is in fact convicted - I really hope he doesn't go to Edmonton - if it's still Edmonton that is - and to have the infamously inept NIS involved - poor bastard I say, unless of course they run true to color (there's that word again).

Considering that the only evidence they seem to have are witness statments, it looks like they have a pretty weak case.

This is a load of shit. This case is gonna do nothing but hinder the abilities of the soldiers over there. Every time a soldier has to look down his rifle at a possible enemy he is gonna question wether or not they're goanna get a 2nd degree murder charge thrown there way. If NIS charged him on hear say then they are stupid. They have to have a absolute ace in the evedence in order to charge him. If you charge him then you should charge me and all the members of every task force that has been there. I fired my 155mm howitzer at a strong hold where there were wounded Taliban, so am I guilty of Murder? Not a chance in Hell! This is war and it is brutal. Yes we would love to do this in a civilised mannor, holding hands and hugging, but diplomacy won't work here. Who ever thinks that you can hold hands a sing Kumbya with these people should go and try cause I can tell you what would happen. ( BOOOOOOOOOM ) Some times you need to create peace and if that is done with the muzzle of a rifle, the Tracks of a Tank, the Muzzlebreak of a Howitzer, and the C4 of a sapper then so be it.

Weak? Aren't the witnesses fellow soldiers? Unless they had a "history" with him, I would think their statements would be pretty damning.

They said he was alone with the body and heard two shots, very suspicious but far beyond a shadow of a doubt.

If they called in a fire mission on someone they knew was a non combatant, you wouldn’t be held accountable the person who called the mission would be. If I set off a charge knowing I would kill outside the ROE's then I would be accountable. This wont make people second guess shooting someone, unless they are critically injured and unarmed.
