A Canadian soldier has been charged with second-degree murder in the death of a presumed Taliban fighter in Helmand province.

    Im quite shocked, CFNIS does not charge someone unless they feel they are guilty of the crime. ROEs also clearly state that you will not fire on an unarmed combatant, we will have to see what the trial brings out. Its also a little puzzling to hear the OMLET was in a tic, they are not front line units. My understanding is that when something like this happens the defendant will stand trial in Canada. If found guilty could spend no more than 2 years in a military prison before being transferred to a National Correctional Facility to serve out the rest of his sentence.

    The CBC should have waited like CTV did in reporting this, this is news.

    He should of stayed in the bleachers and not come onto the field if he didn't want to become part of the game.

    I just hope we don't find out later that it was the Canadian that went into the bleachers.

    According to the Law of Armed Conflict and the Geneva and Hague Conventions, to shoot an unarmed prisoner is a big no-no, and this guy will probably spend the next 25 years of his life in prison.

    Unlike other countries, Canada takes a very dim view of murdering soldiers, and prosecutes them to the fullest extent.

    There have been other cases of murder in Afghanistan committed by Canadians and those who have been found guilty are now in jail for life.

    We dont do cover-ups like the americans!!

    I didnt see unarmed prisoner anywhere in the article,
    you know something we don't stokes ?

    If Semrau is with a training unit, does the ROE apply differently to him ?

    HMMMM, Do you think the Taliban charges their fighters for killing unarmed people?
    Why should we charge a soldier who killed an enemy????
    If this man was unarmed, why was he on the frontlines of a battle?

    CTV News correspondent Steve Chao said the fact that a Canadian soldier is facing charges in connection with the death of an Afghan civilian will not reflect well on NATO forces, which have faced criticism for conducting air strikes that have killed civilians.

    Afghan civilian???? HE was a suspected militant at the begginning of the article, which would have no bearing on NATO accidently killing civilians. I blame the Taliban for hiding behind their human sheilds for this anyways, they are cowards and reflect this when they do such things, (also note that most of them hide their faces when on camera.)

    And if he wasn't armed, what was he doing in the middle of the battle?

    THere's not enough info yet.

    Like anything there are rubber neckers during a battle as well. Or he could have been fighting, dropped his AK and ran away.

    If the person does not have a weapon in his hands you dont shoot at him, unless you (or someone else, sensitive material ect) is in mortal danger. The point is there are several rules in place that you must follow when you have to shoot at someone. If he did not follow the rules then he is guilty.

    Its very hard to make that kind of decision, but I have a feeling it was plain to see to others present that the man who was killed was a non combatant.
