I always thought that photo was in poor taste actually and I didn't "get" the message the band was trying to convey.
I'm surprised that he even tried to further capitalize on it later in life and is now wanting to pursue legal charges.

The bands typically aren't the ones who choose the album art. It's something an entirely separate department in any recording company does.
