Maybe they could go the civil suit route. Driving without due care and attention seems to me to be the minimum that should happen here.

Under Quebec highway rules, any road travelled by more than 5,000 vehicles a day must have paved shoulders.

"I can't understand why on this part of the road, why the shoulder was not paved," said Lareau.

Officials with Quebec's Transport Ministry said the province had planned to repave the section of the highway where the crash occurred, and would also pave the shoulders. Work is to start in the next few weeks, said ministry spokeswoman Julie Morin.

I'm going to suggest to my local bicycle club that we start surveying our roads, and hold our province accountable for creating a safer place for both cyclists and motorists.

Motorists need to remember that cyclists are just another slow moving vehicle.Like a tractor or a street sweeper, old man in a motorhome, etc.

They are expected to stay to the right when its safe to do so,

but they also have the right to take the lane when its not safe on the shoulder.

Too many motorists dont understand this, they see a cyclist taking the lane, and they get upset and angry.

Seems not. But this kind of bullshit happens all the time - blame the cyclist. In BC there is no law how close a car can come to a cyclist to pass, so you get cars brushing by you with inches to spare all the time. It doesn't take much under those circumstances, a little miscalculation on the driver's part, the cyclist pulling left just a little bit, to cause an accident. Other jurisdictions have passed laws mandating 1 meter distance when passing.

IT's the reason Gregor is building separated bike lanes, with of course the attendant howling from the drivers. Apparently they work quite well in Europe.
