Texas, unfortunately, doesn't have a law against imprisoning or giving the death penalty to the mentally retarded.

The above quote says a little something about Texas. This guy should not be in prison and also should not be out in the public. That is a huge problem if their is no other solution.

The problem is the guy doesn't have a treatable mental illness per se. He wasn't diagnosed with schizophrenia or PTSD or bipolar disorder or something you can treat. The guy was just born slow, so I don't think sentencing to a mental hospital option was a possibility for this guy.

Which would even be worse. 8O He doesn't have the capability to understand what he did was wrong and doesn't have a medical problem which could be corrected by treatment. Unfortunately this is the best option for the protection of society.

He would be declared NCR and would be committed to a forensic psychiatric unit.. and probably released to monitored community living when stable... or not.. there are some in our facility who have been there for 20 yrs
