His criminal history plus the fact that he broke his bail requirement of not abusing alcohol twice prior to being re-arrested indicates the sentencing circle recommendation would not have generated a change. Prison is a reasonable step, but I do not expect a change in his future behavior. It does not appear as if he has accepted responsibility for his actions. Without that fundlemental step how can he change to be a model parent and husband. He will most likely be back in court within a few months of his release for some alcohol related crime.

His past and future children will be the victims.

While Morgan was not bound by those recommendations, the circle suggested Pauchay should not go to prison but should be reunited with his wife, Tracey Jimmy, and their other child.

The group also recommended Pauchay receive drug and alcohol treatment, and assist elders with cultural and spiritual activities.


Good. They can start with that in 3 years.

Been awhile but 2 years less a day used to mean you went to a minimum security prison.

Has it changed?

he got three years, Zig, not 2 less a day.

Still nowhere near enough.

I know,any sentence over 2 years means medium security and not minimum.that's why you see lot's of 2 year's less a day or time served which will be less then 2 years.
Medium security is a lot uglier then minimum.
And in Alberta minimum is not very pretty either. :wink:

yet the missus in Labrador who killed two people with her truck while drunk only gets a year of house arrest. how is that right?

They took into consideration past offenses, breaches and lack of ownership

On one hand,Canadians say they want the FN to have self government,look after their own affairs in house,on the other hand,some want them to adhere to the white mans laws.

So what's it going to be?
Anyone got a solution?

We can WANT anything we want, but as long as nothing is arranged, we can't do anything...

Like I can't do anything about that asshole that almost killed me while talking on his cell in the car. It's still legal here.

We can still sentence them according to Canadian (or "white man's", as you wish to call it) law, as long as "they" can not govern themselves.
As far as I am concerned, go ahead. But don't expect a bail-out when it fails.

regardless of FN, past offenses, or any of that crap. ANYONE that kills another person while drunk driving deserves jail time.

thats one this that i think is unforgivible

Empower them to mete out their own justice or let the FN follow our laws,I'm into empowering them because most folks dont have a clue about FN's,me included but I know enough to know our laws arent working.

Yep...was the woman FN?

I believe killing someone while drunk in a car is no different than killing someone with a gun while under the influence.
