gunna have to prove that he is gay for it to be a hate crime. Doesn't make it right and this looser should definitely be charged with assault

I doubt its a hate crime but the offenders should get longer sentances just for being assholes.

I don't think it's gotta be a gay issue. Why can't they try them for crimes against a visible religion. Namely Christianity.

$1:
Section 319 deals with publicly stirring up or inciting hatred against an identifiable group based on colour, race, religion, ethnic origin or sexual orientation. It is illegal to communicate hatred in a public place by telephone, broadcast or through other audio or visual means. The same section protects people from being charged with a hate crime if their statements are truthful or the expression of a religious opinion.


Somehow I don't think these asswipes attack could be considered a religous opinion.

If it was a Muslim singing whatever the hell they sing, they'd have no trouble comming up with a hate crime charge.

$1:
Under Section 718.2 of the Criminal Code, a judge can impose a longer sentence when an offence was motivated by bias, prejudice or hate based on race, national or ethnic origin, language, colour, religion, sex, age, mental or physical disability, sexual orientation, or any other similar factor.


This is BS. Assault is assault, regardless of the motivation. Any case should receive the same sentencing.

I agree with you but apparently the Canadian Judicial system (or what's left of it) doesn't.

So in order to get the maximum bang for the least amount of bucks, use the hate crime scenario.

Possibly, but I didn't bring up the scenario, the police did.

What's the difference between a hate crime against a homosexual and a hate crime against a religion?

All I'm saying is that assault is assault but if you want them to get harsher sentencing why not use every available avenue to see that it happens.
