Whoa what the hell? Fined for hanging up a Canadian Flag. That is complete bullshit, I swear to god if I ever run into that guy. I am giving him a Canadian ass kicking. Then I'll buy a Canadian Flag, come back and beat the shit out of him with it. Then go buy a American Flag, come back and beat the shit out of him with that as I don't think Americans would appreciate this guy either. Then grab the Canadian Flag again, and beat him up some more with it.

The starta nazis are everywhere. Though this does remind me of a Frasier episode along these lines--when his upstairs neighbour unveiled a HUGE American flag right in front of Friasier's front windows and balcony. classic.

Just one of many reasons I will be buying a nice quarter-section in rural Sask. Stratas and home-owners associations are nuts!

If it were me, and I could afford it, I'd just pay the $50 each month and buy a much bigger flag to fly.

This is unbelieveable. I would glady give Mr. Clark $50.00 just to keep the Maple Leaf flying in the face of this STUPID by-law.

The nerve of Dean Clark, flying the Canadian flag in Canada.

$1:
She forwarded a copy of the strata bylaws, which state that "no signs, fences, billboards, placards, advertising or notice of any kind" may be displayed anywhere visible from the strata's common property without written approval from the council.


I don't believe that the Canadian flag or any other nations flag for that matter clasify as a sign, fence, billboard, placard, advertising or notice.

This is completely horseshit by-law.

Maybe we could find the person that complained and ask them which country's flag they would rather see, then ship them there. :)

I watched this on the news the other night and apparently as far as the strata council is concerned it isn't about the flying of the flag but how he's doing it.

He mounted a flag pole to the front wall of his strata and the council became concerned that if any damage to the building envelop was incured the cost would have to be picked up by the whole strata.

If I remember correctly the council told him he could mount a flag pole in his front yard and fly the flag from that but he has so far declined.

He quite possibly has an issue with his strata council and has decided to use patriotism as a way to flaunt their rules and regulations.

Either way it's a stupid scenario created by people with no freakin CDF.

You live in a t-house or a condo, you abide by the strata by-laws. That's it, pretty much.

I agree with Freakinoldguy... I think he's doing this to make a point. If it was about the flag, he'd put it on a pole, like he's allowed to.


For the record - when you buy, you SHOULD know the strata laws.

Then why would they cite the stupid bylaw?


Because quite obviously there strata doesn't have a specific bylaw that says you can't drill holes in the building envelope to mount things. If they had looked a little farther into the British Columbia Strata Property Act they would have found:

$1:
Obtain approval before altering common property
6 (1) An owner must obtain the written approval of the strata corporation before making an alteration to common property, including limited common property, or common assets.

(2) The strata corporation may require as a condition of its approval that the owner agree, in writing, to take responsibility for any expenses relating to the alteration.


So it looks like he could go before the council again and ask permission to mount his flagpole and take "full" responsibility for any damages incured from the mounting of the pole, or he could keep claiming patriotism as the main cause of his problems, when it would appear that he either thinks he's special or just wants to flaunt the rules and regulations pertaining to the strata property act.

Strata bylaws are put in place to protect the value of neighbours property and keep the units looking good. I can't see how a Canadian flag detracts from the value or esthetic appeal of the units.
