Inducing panic in the cattle indicates to me that the dogs were either chasing the cattle or scaring the cattle by their mere presence. That's harm enough. Having 1,000Kg critters running around in a panic is never a good thing.
The farmer was under no obligation to wait for any further harm to occur before putting an end to the threat to his herd.

But if a dog every went after them in the paddocks, then no doubt I, my sister, my aunt, my uncle or anyone else would kill the dog.
