He didn't break the law, he is being restricted under Bill C-51 which doesn't require you to break the law. It granted sweeping powers for authorities to restrict your freedoms preventively.

$1:
Its main provisions would facilitate information sharing among 17 (and some say more than 17) federal institutions, give police powers that would allow them to preventatively detain or restrict terror suspects, ban the “promotion of terrorism,” allow the public safety minister to add people to Canada’s “no-fly list,” and enhance the powers of Canada’s spy agency CSIS.

Harper knew it wouldn't when Parliament passed it. That way he could got on his high horse and claim that the courts are ruling Canada. The best part will be no one will be punished for the violation of people's rights. :(

Most countries accept that freedoms of some people can be limited when they violate the freedoms of others. Otherwise, we couldn't restrict one persons' freedom of movement and put them in jail for violating someone's freedom of security. ;)
