Using your argument on the other thread, I don't think this would stick. I also don't think it's really in the same league as the other. The other incident had someone aggressively challenging the driver whereas here I don't think the driver opened the door knowing she was coming. Now if he did, and the Crown can prove it, then by all means he should be looking at jail time.

If you open your car door and another car rips it off, are you also responsible for the damage to the other car? If so, I guess you're also responsible if you kill a cyclist. You're supposed to make sure it's safe before opening your car door.

But as a cyclist myself, I'm really careful in this kind of situation.


Even more so riding a motorcycle. I don't trust anybody on the road. Most drivers SHOULDN'T be driving.

Yes, it is your duty to check, you are putting an object into the lane of travel.

I ride far away enough from cars to not get doored. Then of course I get the yahoos that try to push you back toward the parked cars.

I doubt the driver will be charged with anything serious, but s/he should be. Just straight carelessness.
