Unless you want a total nanny state, it is almost impossible to ban bad behaviour.

Still, I will be glad once the law is changed and this kind of crap will become illegal, as it will help prosecute scumbags who blackmail young girls after they send out a sext or nude photo (like Amanda Todd).

So...let me get this straight...under the California law, if I post pictures of my wife (with me) in swimsuits, trying them on for a vacation, getting ready to play in the yard, etc...and my wife and I get a divorce...I must take down that picture or risk litigation?

The picture is taken in a private place.
The picture shows identifiable persons is a state of full or partial undress.
The other persons emotional state is solely dependent on whatever she chooses it to be.

Meets all of the criteria for California's Law.

Yup, this type of legality is going to be brilliant.
(this is partially tongue in cheek and partially devil's advocate)

Maybe we should just teach people to stop being idiots and willingly sending pictures of themselves to other people?

Give something to someone as payment for services, later demand they give it back, claim they stole if from you.

Women not even once.

Unless their was illegal access to the device this shouldn't be a crime.

Pretty much, yeah. While I appreciate the intent of the law I can also see your perspective here and I imagine it will become a full-employment opportunity for attorneys.
