I saw those pictures and it totally changed my opinion on the story, it was a prett f'd up injury.

It was fucking nasty, her lawyer was able to prove McDonalds knew they had a problem with their cups lids staying on and that the coffee was at a very high temperature. He was also able to show that in similar situations when patrons of McDonalds had been injured by a product they offered to pay the victim's medical bills.

But...

Should she have held a scalding hot coffee between her legs? No.
If you own a car that does not have cup holders, should you order coffee? No.

Both of parties were stupid, but if you know your cups are defective and have paid out injuries before, why wouldnt you pay the medical bills for an elderly woman?

They had on netflix(dont know if it is still on) a documentary on frivolous lawsuits, it was called 'Hot Coffee'. Some where pretty F'ed up, its worth a watch.

This exact same situation happened to my wife & neice when we stopped for coffee at McD's in Camrose in '88. Fortunately they were both wearing dresses/nylons and the burns tho painful for a few days, were'nt as severe. Immediate dousing with cold water & ointment from the first aid kit helped keep from blistering.
We were plenty pissed off but never thought of suing. Chewed a few asses, got new coffees and headed on our way. Still cautious about 'take out' cups!
