If you break into my house, expect not to leave on your own power....or in a bag.

Unless your wife's a good earner, you're probably going to lose that house while you sit in jail defending it. Of course your tough statements might just be internet talk.

Anybody breaks into your house is fair game for execution.

Exactly. This is because when someone breaks into your house you don't know if YOU are fair game for execution.

By your measure then when Poland was invaded by Germany it was the Poles who were wrong for fighting back.

NO, this case is more like if Germany had invited Poland in and then shot them up.

Let's just hope you don't get burglarized while you're home. Sounds like you and OTI will be bunkmates. Happy showertime to you two. Until execution day, anyway.

That already happened when I was 16. The very large Mexican man did not survive the encounter. He thought I didn't have the nerve to shoot him when I pointed my father's rifle at him and asked him to leave. This was his last mistake.

You have this illusion that you can't kill someone who breaks into your home without going to jail for the rest of your life. You're wrong.

You hug the thug that breaks into your house...I'll protect my family while you'll be an old victim lying in a pool of your own blood.

Andy thinks you should be on death row. You should have stopped to talk to him first, do a mental assessment and then decide if you're at risk.

Tell it to the guy this thread is about, that you defended. You act like him, your wife will be shopping for a new husband, because 25 years is just too long to wait.

Most often, people that kill others that break into their home aren't charged at all.

The only thing this guy did wrong was tape his actions. If had had of done what he did and just called the cops, it would have been overwith.

Well it appears AndyT is pro criminal. People who commit a crime should have no fear of any one standing up for themselves and if they do by God that person should spend life in jail. How dare you protect yourself, your belongings or even loved ones from criminals who break into your house. These criminals are only there to do a criminal act and should be left alone to do it.

Fortunately, the jury disagreed with you. You can, and always have been able to, protect your home even with deadly force. There are rules for the use of deadly force. They do not allow for ambush and murder, which is what happened here. The "finishing shots" to the head would have been evidence depsite the audio tape. The rules for justifiable homicide do not cover "finishing shots." Even if you justfiably have to shoot someone, if they are disabled and no longer a threat or unable to continue a felony, you can't simply execute them.

the tape the tape:
Soon, there was another booming gunshot and the sound of Kifer falling down the stairs. Smith quickly said, “Oh, sorry about that.”

“Oh, my god!,” Kifer said, and screamed.

“You’re dying,” Smith responded amid more gunshots. “Bitch.”

Why am I not suprised you'd support behaviour like that?

Really andy? Now simply not being at home(or pretending you're not) is an invitation to break in? No wonder you got your knickers all in a twist about this, it's restraint of trade I tells ya.

Leaving a window open has been ruled as an invitation to enter. Sitting by that window with a shotgun and killing the person entering, was deemed as 1st deg murder, same as in this case. Was a little old lady that did it too.

Even in the states what this guy did was deemed 1st deg. In Canada you'd better be able to prove you were in dire fear of your life before you shoot, or you'll be joining OTI in his cell.
