PostFactum PostFactum: So that man had a good reason to shoot him. In my city we had something like that few years ago, a retired man saw a robber on his yard and killed him from one shot. He received a medal "For bravery" from cops. Here, that man goes to prison.

You don't have the necessary defense of property? You cannot kill someone for stealing from you. You may you proportional force in self defence, up to killing that person if that person is about to kill you, but that's it. The only force you can use in defence of property is if you try and conduct a citizen's arrest of the perpetrator, and then, only minimal force is allowed.

And the moral of the story is..............don't mess with the old folk.

Yep, even the old west days, shooting someone in the back no matter who they were, was gonna land you in a shit-load of trouble.

Freakinoldguy Freakinoldguy: But either way the guy is gonna get screwed. The theif gets an unecessary ride in an air ambulance and likely nothing for punishment, since theft under $5000 is a nothing charge, while the farmer is likely to end up with a large fine, jail or at best probation. So if that happens it'll confirm what I said before about the judicial system once again punishing the victim. Well, ground and air ambulance are not insured in Alberta so this guy is at least looking at an pretty high bill. There may be some kind of maximum response time standard for ground ambulance that could not be met.

But I can see the air ambulance being called in for a gunshot victim, which, as much as it nauseates me, technically this guy was.

I know that the benefits to growing old are few and far between, but one of 'em is that for guys like us, 'Life in prison' is just a 'short sentence'!

Yogi Yogi: Hey Fog. I know that the benefits to growing old are few and far between, but one of 'em is that for guys like us, 'Life in prison' is just a 'short sentence'! True, but that statement should apply to a much larger portion of the prison population than it does now. In some cases, prison should just be a way station between crime and eternity.
