Police: Former Marine Shoots 2 Subway Robbery Suspects Customer Kills 1, Wounds Another, Police Say
UPDATED: 4:41 pm EDT June 28, 2007
PLANTATION, Fla. -- A retired United States Marine disrupted a robbery in progress when he shot two men who attempted to rob a Subway sandwich shop, fatally wounding one of them, police said.
According to Plantation police, two armed men barged into the Subway at 1949 Pine Island Road shortly after 11 p.m. Wednesday, demanding money from the employee behind the counter. When they tried to force John Lovell into the bathroom, he pulled out a gun and shot both men, police said.
Donicio Arrindell, 22, was shot in the head and later died at the hospital. Fredrick Gadson, 21, was shot in the chest and ran from the Subway, but police found him in hiding in some bushes on the property of a nearby BankAtlantic.
Lovell, 71, was the lone customer at the time. Police said he had a concealed weapons permit. A witness who was about to enter the Subway at the time said he thought the shootings were justified. "I think justice, you know, was served and a civilian was a hero for today," Sebastian Shakespeare said.
Police said Lovell, a retired Marine, wouldn't be charged.

That's obviously a different situation - the lives of innocent people are potentially at risk, and they tried to force him into the bathroom. He's got reasonable grounds to suspect his life or the lives of someone else are in danger.

Yes, it is a different situation. There's been lots of discussion on how the guy in the previous story was unjustified in shooting the two burglars. In this story the bad actors are clearly armed, yet was it their intention to actually murder the worker and customer, or gain time to escape by locking them in the washroom? Would any action short of shooting both robbers have caused them to flee?

WTF? Is there no justice?
No offence to the US but this is entirely why I believe in a strong country wide federal govt with equal laws in both application and punishment.

America is the world's 300 million people circus. Laugh away.
I just wonder how things will change as the blacks and Mexicans continue to grow as a percentage of the total population.

The fact that the castle doctrine/mentality exists, is proof that the criminal justice system is failing. People no longer feel that the police and courts can or will protect them from criminals, and feel compelled to take the law into their own hands. This is further evidenced by the growth of gated communities. People's perceptions are that, they aren't safe, and until such a time that people feel safe, and have had their confidence in the criminal justice system restored, this seige mentality will continue. The problem partially lays with a judiciary that has 'liberal' views in regards to the reasons for crime and how to deal with it. All well intentioned of course, but we all know the old adage about good intentions, and what is happening demonstrates a distinct slide in that southerly direction.

Agreed.
What am I missing here people. If you step foot on my property prepare to have your ass handed to you. What i find really funny is that if these two people had broke into the neighbours house and say killed a cat or were trying to steal something very sentimental we would all be praising this guy. I think he aboslutley did the right thing.
Oh and one more thing IT's TEXAS, FFS. If you are stupid enough to commit a crime in texas then you deserve to be shot
Ahh, that explains Texas' unbelievably low crime rate.

Under Texas law, people may use deadly force to protect their own property or to stop arson, burglary, robbery, theft or criminal mischief at night.
Another excellent reason to not go to Texas, let alone live there!

I am sure crime is at an all time low now in that man's neighborhood.
