Diggerdick hates the cops but is all for the 'old' system.
Well, for the uneducated on impaired driving in Canada.
The 'old' system and the current system means that the stupid old police have 52 forms to fill out for each impaired driver. The amount of forms relates to the various court imposed case-law verdicts, not police bureaucracy. The results of the expensive and well calibrated intoxilizer are challenged at EVERY impaired trial. When was it built, are we sure it works, what colour was it etc. Meaningless waffle but the judges dig it.
The defence lawyers are very well versed in challenging every line of those 52 forms and it’s pretty obvious that it’s not the drunk driver on trial but the officer who arrested him/her.
Hence the Ontario stats of a 30% conviction rate at trial for drunk drivers. Everyone of the 70% who walked free blew well over the legal limit but that's not what interests the courts. It's the fact that 'the 51st form had a typo so we can't convict' that matters.
But diggerdick prefers the ‘old’ system. Very telling.
If anybody doubts what I've posted, pop along to your local court-house and see it for yourself.

Your post reminds me of a job interview I had here a few years ago. We came about speeding, and he said: "ya know, just drive 10% over the limit. They can't hang you for that, and if they do, you take 'em to court. You'll always win and it will be thrown out." I remember thinking: "What kind of an attitude is THAT??"

As a person who has been arrested for DUI I am all for 0 tolerance.

EyeBrock understands that I do not hate police.
I only hate police incompetence and corruption.
When it comes to charging anyone with any crime, including impaired driving I don't believe making things simple is the answer.
and the fact, that people got off with impaired driving simply because a police officer cannot fill out forms correctly or does not have the ability to see a typo is not the fault of the courts.

Why should an officer have to fill out 52 pages in the first place? OF COURSE there will be mistakes made, cops are only human. And, to fair, they have another job to do than fill out paperwork, hire a secretary for that, it's what they DO. But I take it they can't. In any case, 52 pages for a DUI is ridiculous, considering I had to fill out 42 for my immigration.

diggerdick diggerdick: anyone who lives in British Columbia, and has to deal with Gordon Campbell's demented and delusional right wing pro-business policies are quite fed up with giving him a break.
These new laws, will add greatly to the government coffers but do very little to get true impaired drivers off the road.
chronic drunk drivers who blow well over the legal limit and will drive with or without a license.
But the person that has two glasses of wine at a restaurant with a meal and maybe close to the .05 blood-alcohol level will pay greatly.
There was nothing wrong with the old system. people that did get away with impaired charges were because of mistakes made by the police and the paperwork that they did. Now most of those mistakes will be overlooked, not to get true impaired drivers off the road , but to make money . This is where you take the thread a turn it into "whatever it is, it's the fault of the police"

Perhaps.
But as I said before, it will be interesting to see what new loopholes are discovered when the next police officer in British Columbia gets nailed for drunk driving.

Exactly. I don't. Immigration is a one time thing, takes 3 years, minimum. 42 pages about your life, your family, your history, your education (and all translated), fine. But doing this shit EVERY DAY 15 times?? Ridiculous. You think it's ok the police should? I don't. I think a whole lot less forms would be ok. They have the proof you were driving drunk. 1 form. They have your id. Another form. Done.

but it will be interesting, to see what new loopholes will develop when police officers and politicians get caught in these new laws. Well, try to get stopped near your house. Run from the scene, hope the cops don't catch you, and then return. Claim that being stopped shook you up so much, you ran home and had a few belts to steady your nerves. It worked for taser boy Robinson, it should work for you.
