There are 4 reasons for sentencing: Punishment, Rehabilitation, Segregation and Deterence. Clearly, a 93 year old man doesn't need Rehab or Segregation for public safety. But sexual assault is a horrible, hurtful, violent crime and regardless the age of the crime or the perpetrator, a sentence needs to be imposed for punishment and for general deterence.

ok, so a 93 year old man needs to go to jail, and a 42 year old native who left his kids in the boofuckinmiddle of nowhere in -30, killing them, just needs to be "sentenced by a circle" or instutionalized in a mental facility?

I agree, but a line has to be drawn at when making messages becomes

Not stupid at all. There needs to be deterence. You don't want to send the message that, if you rape your daughter, you might get away with it if no one finds out for a long time and that's absolutely the wrong message to be sending. General deterence must an aim when sentencing, especially violent crimes.

Sure he can defend himself, that's what lawyers are for. I've never been a victim of incest so I don't know how it feels but to tell them to just get over it is pretty callous. Think about how you'd feel if it happened to your children.

If you can live with it for 50 years, WHY would you make a case after that long?
