seems so:

Lawyer Dino Bottos said the plea shows that the Crown and the defence agree Suter was not impaired when he pressed the wrong pedal and crashed into the patio.

Suter will offer his side of the story during the sentencing hearing, Bottos said.


Not the first time this has happened with a sober driver.

He refused to provide a breath sample, so we'll never know if, or how intoxicated he was. No idea why someone who was sober would refuse to provide a sample, after being involved in an accident that claimed someone's life.


$1:
Following the crash, patrons saw what they deemed to be signs of impairment on part of the accused and a police officer noted the smell of alcohol on Suter.


However Bottos said Suter knows the Crown will still be looking for a "substantial period of incarceration." The maximum penalty he could face is 14 years in prison.

And his dreams of a career as a movie critic are dashed, since he's now only able to give mixed reviews at best.

I call bullshit. Most modern vehicles require the foot on the brake to take it out of Park. How can a sober person then confuse it with the gas when your foot was already on it?? How can you put it in 'Drive' when you meant to 'Reverse' out of a parking spot, then confuse the brake with the gas?

In an agreed statement of facts, Suter approached a parking stall at Ric's Grill at 142nd Street and 23rd Avenue and drove completely through a plate glass divider, striking a table.


Doesn't sound like any of the things you describe happened - he was going forward to park and hit the gas instead of the brake. Happens all the time.

If he was sober tho, he got some bad advice from his lawyer, should have provided the breath sample.

The original reports were that he got into the vehicle, while leaving the grill. Then drove through the glass, killing the child and injuring the mother.
