He paid for his screw up with his life. The only real victim in this case was the daughter.

It was negligent as fuck, which is all it needs to be for a conviction.

Let us know what you think after you get a drivers licence and own a car.

Well for me, I've driven several hundred thousand kms at least, and I've never, for any reason, brought my car to complete halt on the inside lane/shoulder of a highway, unless the traffic was already at a standstill.
I think the ruling is fair. It may not seem so in the general scheme of our "justice" system but looking at it objectively it is pretty reasonable.

I've probably done more than a million.

Last time, tire blew on the highway, in the fast lane.
I was able to get over to the right, beginning of an off ramp, stop the car, change the tire.

It isn't that hard to do.

Stopping in the fast lane is a just a recipie for disaster; she is proof of that.

Hope the ban sticks.

I'm sorry what lane did you stop in?

Their is no fast lane. Learn to drive, it's the left lane of travel.

It's a passing lane, thus usually resulting in a faster speed.

You sound like one of those who get into the left lane and then drive the same speed as the vehicle beside you in the right lane.

There's a time for being a radical animal lover (nothing wrong with that!) and then there's the middle of a highway.

What does it matter what she stopped for. What if she stopped for a body that was clearly dead on the road and then this all happened. Or she stopped because there was a large chunk of steel or debris on the road. Stopping for some ducks just shows she has a heart.
The sentence seem bizarrely high considering the slap on the hand that others get for causing death and damage behind a wheel.

A thought occurred to me this morning as this story came up on CNN:

Had the woman stopped to protect a family of endangered ducks then the animal rights crowd would be falling all over themselves to give this woman a medal and Environment Canada would be recognizing her for helping to assert the Environmental Protection Act.

I think the lesson I've learned here is that the next time some drunk homeless guy staggers out in front of my car while I'm driving down East Hastings, I am legally obliged to run him down.

Exactly! Then they look so surprised after you run them into the ditch. At least I think they look surprised.

Seems to be the message here.

Right, because a duck's life is equivalent to a human life

Some dick of a judge is certainly going to use this precedent to eventually put all the blame on someone if their vehicle breaks down and gets slammed into from behind by some jackass doing lightspeed. The Canadian system seems quite effective at making one party the illogical source of all blame in situations where to any other rational person both parties deserve to share the responsibility.
