Here's something that should go in the 'Omnibus Deporables' thread. If you check the website they set up to see if your information was stolen - the terms and conditions you agree to to use the website state that you won't sue Equifax for the breach of your data. :twisted:

I'm of the opinion that many of those click through agreements are not enforceable because many have the clause 'we can change these terms without prior notice', which eliminates the consent that must exist when agreeing to a contract.

But their lawyers are better than my lawyers, so they get to write the laws. :(

You can't legally put terms and conditions in contracts that go against the law.

Well... it might not be illegal, but you could still sue.

You can put whatever terms you want into a contract and if you can afford to file enough motions and etc. to bankrupt the other guy then it doesn't matter if the contract is legal or not.
