Don't know why these companies keep trying to go through their land when this is the sort of thing that always happens. Just tack on the extra miles to go around the reserves and eat the fucking extra cost to get the job done. They'll more than make their money back in the forty to fifty years the damn lines will be in service.
I don't think this is about reserve land, but "traditional territory." As Herbie pointed out, FNs claim more than 100 percent of BC land, so going around would mean just going around BC.
The courts have said the govt must engage in meaningful consultation with FNs about use of their traditional territory, whatever the fark that means. But the govt legally can declare that the use is necessary and thus override any FN veto. Thing is, is there a govt out there that has the cajones to do that, deal with the inevitable protests.
Harper did the oil companies no favor by trying to ram things thru, just wound up causing even more problems for the projects. Including the Keystone one.
