So if I work out of my home (no other employees) I can get a ticket for smoking!

Not if you refuse to let the cop into your house, which is your right.

But if he sees me though a window, he can, which is pretty much how the trucker got a ticket. :?

Nope. Your house is different than your car. They can't come in unless they witness a criminal offense in progress or have a warrant.

Maybe they can sort this kind of thing out with "Randomly" stopping vehicles.

Not yet, but I'm sure Uncle Stevie's considering it.

So really...could you get in trouble for smoking in a park or in front of a business?

$1:
Truckers from across Canada were fuming Wednesday night as word spread that Ontario police fined a driver $305 for smoking in his rig, which the law considers his workplace.

I'm sure the truckers are quite happy to consider it a workplace when it comes to the enforcement of occupational health and safety laws. In that case it works to their advantage.
