The temminoligy differs from State to State. DUI,DWI,OUI,OWI,OVI, the list goes on. To further complicate matters, some States have a multi-tier approach to the problem. Several States have a BAC standard to convict of driving while intoxicated, but can still get a lessor conviction of driving while impaired for a lower BAC reading. Unfortunately for Mr. Khabibulin, he was arrested in Arizona. Arizona is one of a few States that have enhanced penalties for higher BAC readings. Arizona has the charge of exrteme DUI for a BAC reading of .15 to .199. Super extreme DUI applies to a BAC reading of .2 or above. Mr. Khabibulin was convicted of extreme DUI, and thus must serve jail time.

It will be interesting to see how Canadian Immigration views this case. Americans convicted of DUI are considered inadmissable to Canada. Mr. Khabibulin is not a Canadian citizen [is he?]. If he is allowed to continue his hockey career, it would appear as though professional athletes are above the law.
