Then why are they keeping it and not releasing it? If they have this video like you say wouldn't that be withholding evidence in a criminal investigation, something I don't think the Crown would be to appreciative of especially considering everyone in Toronto who isn't named Rob Ford is out to get the one that is.

The police are withholding evidence in a criminal investigation? Come on. The perp would know if they have the tape, since they took it off him. The other story is that he tried to bargain for a lesser charge for the tape, but the crown said no. Police have refused to answer many questions in this matter, because it's "sensitive", ie somebody with clout is involved.
