Although I haven't heard of this case before but sometimes laws don't make sense. He might have done what he thought was the humane thing to do, to put someone out of his misery, but at the same time he does not have the right to take a life like that.
I can see the courts predicament aswell, let him go and that might give a green like to some trigger happy rednecks who might declare open season on the injured or make claims they were going to die anyways and at the same time if found guilty..........
I'm just glad I'm not the one deciding this, although personally from the short article Looks like it wasn't done in cold blood or any other kind of malicious intent. I would let him go.

We can't have field officers making their own rules of war up, honourable or not.
